What is International Trademark Registration?

International trademark registration allows businesses to protect their trademarks in multiple countries through a simplified process. This system is administered by the World Intellectual Property Organization (WIPO) under the Madrid System for the International Registration of Marks.

The Process of International Trademark Registration

1. Home Country Registration: To file an international trademark, you must first have a valid trademark registration or application in your home country. This is known as the “basic application.”
2. Filing the International Application: Once your trademark is registered (or filed) in your home country, you can submit an international application through the national or regional trademark office to WIPO.
3. Choosing Designated Countries: In your application, you’ll need to specify the countries where you want protection. As of today, over 120 countries are part of the Madrid Protocol.
4. WIPO Examination: WIPO will examine the application to ensure it meets the necessary requirements and then forward it to the trademark offices of the designated countries for further examination.
5. Examination by National Authorities: The trademark offices of the designated countries will then examine the application in accordance with their laws. They may refuse the trademark if there is an issue (such as a conflict with an existing trademark).
6. Trademark Registration: If no objections arise within the specified period (usually 12 to 18 months), your trademark will be registered in the designated countries. You will receive an international registration certificate from WIPO.
